Welcome to Klutchh ("we", "our", "us"). By accessing or using our website and services (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our Service.

2. The Service

Klutchh provides AI-powered analysis of sports performance videos. Our Service is offered through different subscription plans ("Tiers"), including a free version ("Athlete Tier") and paid versions ("Legend Tier"). The features available to you will depend on your chosen Tier.

3. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content

You retain all ownership rights to the videos and data you upload to the Service ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, process, and display your User Content solely for the purpose of providing and improving the Service.

For users on our Athlete Tier, User Content is processed in real-time on your device and is not stored on our servers after the analysis is complete unless you choose to save it. For users on paid Tiers, we store your saved analysis data to provide features like progress tracking and historical analysis. We use industry-standard security measures to protect your data.

5. Privacy Policy

Your privacy is important to us. Our Privacy Policy, which is part of these Terms, explains how we collect, use, and share your personal information. By using our services, you agree to the collection and use of information in accordance with our Privacy Policy.

6. Prohibited Conduct & Intellectual Property

You agree not to use the Service for any unlawful purpose or to engage in any conduct that could damage, disable, or impair the Service. You may not upload any content that is illegal, defamatory, or infringes on the rights of others.

The Service and its original content, features, and functionality, including but not limited to the AI analysis engine, rules, and feedback logic, are and will remain the exclusive property of Klutchh and its licensors. You agree not to copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material on our Service. You must not attempt to reverse-engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying ideas or algorithms of the Service. Any unauthorized use or reproduction of our proprietary engine is a breach of these terms and may result in the immediate termination of your account and potential legal action.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind. The analysis provided is for informational purposes only and is not a substitute for professional coaching or medical advice. We do not guarantee any specific results or improvements in performance or prevention of injury.

8. Limitation of Liability

To the fullest extent permitted by law, Klutchh shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.

9. Termination

We may terminate or suspend your account at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

10. Governing Law

These Terms shall be governed by the laws of the jurisdiction in which our company is based, without regard to its conflict of law provisions.
